BY ACCESSING THE SITE YOU AGREE THAT THE STATUTES AND LAWS OF THE UNITED STATES AND THE STATE OF MICHIGAN, U.S.A., WITHOUT REGARD TO CONFLICTS OF LAWS PRINCIPLES, WILL APPLY TO ALL MATTERS RELATING TO USE OF THE SITE, AND YOU AGREE THAT ANY LITIGATION SHALL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE STATE OR FEDERAL COURTS IN MICHIGAN, U.S.A. For any information sent, you grant Howard Miller and its associated companies an unrestricted and royalty-free, irrevocable license to use, reproduce, display, modify, transmit and distribute the information, and agree that Howard Miller is free to use any ideas, concepts, or techniques for any purpose, including but not limited to developing, manufacturing, and marketing products using such information.

For European Customers Purchasing Products on 3rd Party Marketplaces
The goods will be imported on behalf of the consignee/ebuyer. The consignee authorizes Howard Miller to import the goods on his behalf. Further, the consignee/buyer agrees that Howard Miller may delegate the obligation to import the goods on his behalf to a subcontractor (e.g. customs broker). The consignee will pay the taxes & duties in addition with the purchase price of the goods.

Mobile Messaging Terms and Conditions

Howard Miller may offer an optional mobile messaging program in connection with the Site (the "Mobile Service"). The Mobile Service includes the ability for customers with United States mobile phone numbers to receive text messages (SMS and MMS) related to Howard Miller products and services.

By enrolling in the Mobile Service, or by otherwise providing your mobile phone number to Howard Miller and affirmatively agreeing to receive text messages, you agree to these Mobile Messaging Terms, which form part of these Web Site Terms of Use.

Scope of Messages
By enrolling in the Mobile Service, you consent to receive text messages that may include:

  • Marketing and promotional messages

  • Abandoned cart reminders

  • Order confirmations and updates

  • Other transactional and informational messages related to your interactions with Howard Miller

Consent to receive mobile messages is not a condition of any purchase.

Who May Enroll; Territory
The Mobile Service is intended only for residents of the United States with U.S.-based mobile phone numbers. By enrolling, you represent that:

  • You are located in the United States

  • You are the account holder for the mobile number you provide, or you have the account holder’s permission to enroll

If you are located outside the United States, you should not enroll in the Mobile Service, as different marketing and privacy laws may apply in your country.

Message Frequency and Charges
Message frequency may vary, including due to your interactions with us (such as starting a checkout and not completing it, which may trigger abandoned cart reminders).

Howard Miller does not charge a fee for the Mobile Service, but standard message and data rates may be charged by your mobile carrier. All charges are billed by and payable to your mobile carrier. Check your mobile plan and contact your mobile carrier for details.

How to Unsubscribe and Get Help
You can unsubscribe from marketing texts at any time. Unsubscribe at any time by replying STOP or clicking the unsubscribe link (where available). You may also contact us using the contact details provided on the Site to request removal of your mobile number from our marketing text program.

For help regarding the Mobile Service, reply HELP to any message, or contact us at the customer service contact details listed on the Site.

Even after you opt out of marketing texts, we may still send you messages as permitted by law that are transactional or informational in nature (for example, messages related to an order you placed).

Supported Carriers and Availability
Delivery of messages is subject to effective transmission by your mobile carrier and is outside the control of Howard Miller. The Mobile Service may not be available on all carriers or in all areas, and Howard Miller and the mobile carriers do not guarantee availability or performance of the Mobile Service (including message delivery or timeliness).

You are responsible for ensuring that your mobile number is correct and up to date. Howard Miller is not liable for delayed or undelivered messages, or for messages sent to a number that you have provided incorrectly or that no longer belongs to you.

Privacy and Data Use
Information we collect in connection with the Mobile Service, including your mobile number, message content, message timestamps and delivery information, is handled in accordance with our Privacy Policy available on the Site.

Text messaging originator opt-in data and consent will not be shared with any third parties for their own marketing purposes. We may share such information with our service providers solely to support the operation and delivery of the Mobile Service, subject to appropriate contractual restrictions.

Changes and Termination
Howard Miller may modify or discontinue the Mobile Service (in whole or in part) at any time, with or without notice. Your continued use of the Mobile Service following any changes constitutes your acceptance of those changes. Howard Miller may suspend or terminate your enrollment in the Mobile Service if we believe you are in breach of these Terms or using the Mobile Service in an unlawful or abusive manner.

HOWARD MILLER DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE, VALIDITY, ACCURACY, OR RELIABILITY OF, OR THE RESULTS OF THE USE OF, OR OTHERWISE RESPECTING, THE CONTENT OF THE SITE OR ANY OTHER WEB SITES LINKED TO OR FROM THE SITE. THE CONTENT OF THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. HOWARD MILLER WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO THE USE OR THE INABILITY TO USE THE SITE, ITS CONTENT OR LINKS, INCLUDING, BUT NOT LIMITED TO, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
